1. Who you're contracting with

These Terms & Conditions form an agreement between you and JTathleticsco.com ("JT Athletics", "we", "us") governing your use of our website and coaching services (the "Service").

2. Acceptance

By creating an account, purchasing a plan, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service. You confirm you are of legal age in your jurisdiction (or have your guardian's consent) and have authority to enter into this agreement.

3. The Service

JT Athletics provides personal training guidance, nutrition plans, workout programming, and check-ins delivered digitally (including by text/messaging). Coaching is educational and motivational in nature and is not medical, physiotherapy, or dietetic advice. Consult a qualified healthcare professional before starting any training or nutrition program.

4. Accounts

You must provide accurate information and keep your account credentials confidential. You are responsible for activity under your account. Notify us promptly of any unauthorized use.

5. Acceptable use

You agree not to misuse the Service. In particular, you must not:

• Use the Service for any unlawful purpose or in violation of any regulation.
• Engage in fraud, spam, or deceptive activity.
• Infringe any intellectual property, privacy, or other rights of others.
• Interfere with the security or operation of the Service, including introducing malware, probing, scanning, scraping, or attempting to gain unauthorized access.
• Resell, redistribute, or share access to paid coaching content without our written consent.

6. Intellectual property

JT Athletics owns all rights, title, and interest in the Service and its content, including training plans, meal plans, PDFs, software, and branding. We grant you a limited, non-exclusive, non-transferable right to access and use the Service and coaching materials for your personal, non-commercial use during your active subscription. You must not reverse engineer, copy, or circumvent any technical limitations.

7. Payment, subscriptions, taxes, and refunds — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

All payment, billing, currency, tax, subscription renewal, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and Paddle's Refund Policy, together with our own Refund Policy. Subscriptions renew automatically on the interval you selected at checkout until cancelled. You can manage or cancel your subscription at any time from your account or via paddle.net.

8. Service availability

We work hard to keep the Service running, but we do not guarantee it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Health disclaimer & assumption of risk

Physical training carries inherent risk. You represent that you are physically capable of undertaking the training and nutrition guidance provided and that you have consulted a physician where appropriate. You assume all risk associated with your training and use of any plans provided.

10. Limitation of liability

To the maximum extent permitted by law, JT Athletics' aggregate liability arising out of or relating to the Service will not exceed the fees you paid to us in the six (6) months prior to the event giving rise to the claim. We are not liable for indirect, consequential, incidental, special, or exemplary damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by our negligence where such limitation is prohibited by law.

11. Suspension and termination

We may suspend or terminate your access to the Service for: material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. You may cancel your subscription at any time as described above. On termination, your right to access the Service ends and we may delete your account data after a reasonable period, subject to legal retention requirements.

12. Indemnity

You agree to indemnify and hold harmless JT Athletics from any claims arising out of your misuse of the Service, your violation of these Terms, or your infringement of any third-party rights.

13. Governing law

These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Michigan, unless applicable consumer law requires otherwise.

14. Changes

We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
